Drafting expert opinions and legal positions on tax law / Preparing tax law expert opinions and legal briefs
Drafting tax law expert opinions and legal briefs on behalf of our Clients is one of our core services. In accordance with individual arrangements with our Clients, we prepare legal tax opinions on the tax implications of existing as well as potential factual scenarios presented by the Client.
When drafting an opinion, we primarily present our own expert position regarding the presented factual situation or planned undertaking of our Client, while highlighting the positions taken by tax authorities, administrative court jurisprudence, and views expressed in legal literature.
At the Client’s request, tax law opinions and expert reports can also present several alternative business solutions or planned scenarios, specifically outlining the tax consequences and potential tax risks associated with each option. In such cases, our expert opinion or report includes a recommendation for the most advantageous solution in our assessment, taking into account its tax implications.
This service can be provided on an ad-hoc project basis or as part of an ongoing retainer for day-to-day tax advisory services.
When provided under an ongoing collaboration agreement, the service fee is calculated based on the actual hours logged by our experts in drafting the opinion. For individual, standalone assignments, the price reflects the time required to prepare the opinion as well as the complexity of the Client’s matter under review.
